Polo mint shape can’t be trademarked

Nestlé has lost its appeal against a High Court ruling that it can not register the Polo mint’s shape as a trademark.

Nestlé has lost its appeal against a High Court ruling that it can not register the Polo mint’s shape as a trademark. It originally lost the case last December, because it did not specify the colour or size of the mint (MW December 18, 2003).
